Terms of Use

These terms of use “Terms” bind you to the terms and conditions set herein in connection with your use of WooChess Inc. (collectively "WooChess", "We", "Us", or "Our") software, website or mobile application.


1.       General


1.1   These Terms contain the entire understanding and agreement between us and you in relation to your use of the Site and supersede and replace any representation, statement or other communication (whether written or otherwise) made by you or us which is not contained herein.

1.2   To the extent that anything in or associated with the Site is in conflict or inconsistent with these Terms, the Terms shall control.

1.3   We reserve the right to vary these Terms at any time. Our new Terms will be displayed on the Site and by continuing to use and access the Site thirty (30) days after such changes have been posted, you agree to be bound by any variation made by us. It is your responsibility to check these Terms from time to time to verify such changes.

1.4   You will not sign any contact related with the use of the site.

1.5   You will not upload, post or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes or any other form of solicitation (commercial or otherwise) through the site.

1.6   You will not post or provide any inappropriate, offensive, racist, hateful, sexist, pornographic, false, misleading, incorrect, infringing, defamatory or libelous content or information.

1.7   You will not have an unauthorized access to other persons’ account.



2.       Students


2.1   Students are responsible for searching, selecting and contacting chess instructor through site. We neither confirm nor deny the accuracy and validity of information provided by Instructors.

2.2   You have read, understood, and agree to be bound by the pricing information before registering for a class.

2.3   If you are under the age of 18, you will only use the services with the involvement, supervision and approval of a parent or legal guardian.

2.4   Students understand that teacher may terminate their accounts with WooChess at any time and become inactive. WooChess does not guarantee teacher availability to students and is not liable relating to teacher availability.

2.5   Students may ask for a refund from a teacher if the teacher becomes unavailable and does not continue and/or finish the trainings.


3.       Teachers


3.1   Teachers are responsible to register themselves as a chess trainer, and need to fill all information required to become a teacher. As a teacher you will use a website for chess trainings and webinars.

3.2   As a teacher you are responsible to create puzzles, trainings, games, homeworks and any other training materials that will facilitate chess trainings.

3.3   Teacher may terminate their accounts with WooChess at any time and become inactive. WooChess is not liable for teacher availability to students. Teachers should take the responsibility to their students.

3.4   Students may ask for a refund from a teacher if the teacher becomes unavailable and does not continue and/or finish the trainings.


4.       Pricing and Payment


4.1   Pricing of training and webinars is determined by teachers. Each teacher may ask for a different price. If you are a student, you agree to pay fees for a class or webinar you are registered for, hereby authorize Us to charge Your credit card for such fees. If your credit card is declined, you agree to pay us the amount due within ten (10) days of the declined payment, and pay (at our discretion) a late payment charge fixed at 1.5% per month, or the maximum permitted by law, whichever is lower. If your account is past due, we may also block your access to the Site pending payment of the amounts due by you to WooChess.

4.2   All payments are made to WooChess, Inc.

4.3   Teachers will be charged 10 % from their estimated price plus withdrawal fees (which may differ depending the withdrawal method You choose) per each registered student.

4.4    The price and fees are quoted in United States Dollars.

4.5   Registering accounts, both for Students and Teachers are free.


5.       Third Party Links


5.1   You may find links to other websites or resources on the Site, provided either directly by or through courses or Students or Instructors. We do not endorse any of these third party sites and do not control them in any manner. You acknowledge and agree that we are not responsible for the availability of such external sites or resources, and are not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources.


6.       Support and Updates


6.1   WooChess may, time to time provide updates or upgrades to the Site.


7.       Termination


7.1   We may terminate your use of the Site immediately without notice for any breach by you of these Terms or any of our applicable policies, as posted on the Site from time to time. We may discontinue offering any product, course (which will terminate your right to offer such course if you are an Instructor), or Our Content at any time.


8.       Confidentiality


8.1   You may obtain direct access via the Site to certain confidential information of WooChess including without limitation technical, contractual, product, program, pricing, marketing and other valuable information that should reasonably be understood as confidential (“Confidential Information”). You must hold Confidential Information in strict confidence. All right, title and interest in the Confidential Information remain with WooChess.

8.2   By submitting or sending User Content to us, you:

a.       represent and warrant that the User Content is original to you, that no other party has any rights thereto, and that any “moral rights” in the User Content have been waived; and

b.      you grant us a royalty-free, unrestricted, worldwide, perpetual, irrevocable, non-exclusive and fully transferable, assignable and sub-licensable right and license to display, use, reproduce, incorporate, modify, create derivative works from and distribute the User Content (in whole or part).
